23 yr old Man acquitted in fatal shooting

Cape Coral - A jury took just 40 minutes Thursday to find a Cape Coral man innocent in the 2004 shooting death of his friend.

Some family and friends gasped and started crying after the verdict was read. Joe Maconi — father of 21-year-old shooting victim Michael "Anthony" Maconi — simply dropped his head and clasped his hands.

Christopher Phillips, 23, faced up to 30 years in prison for the manslaughter charge, but he walked out of the Lee County Justice Center a free man.


According to investigators, Phillips was holding his .40-caliber Glock handgun when he shot Maconi, 21, of Cape Coral in the head on Oct. 18, 2004.

Phillips told police he didn't know the gun was loaded. The prosecution tried to prove Phillips showed negligence and disregard for human life, and that he aimed the gun at Maconi and pulled the trigger. Worcester said Phillips should have checked the gun to make sure it wasn't loaded.

He shouldn't have point the gun and pulled the trigger without knowing what he was pointing the gun at.
